1099-NEC vs. 1099-K: What Signing Agents Need to Know

Understanding the differences between these two information returns and how to reconcile them.

1. Form 1099-NEC Overview

Form 1099-NEC (Nonemployee Compensation) reports payments of $600 or more to nonemployees. Signing companies and title companies send this form when they pay you directly as an independent contractor. The amount reported in Box 1 flows to Schedule C, Line 1.

2. Form 1099-K Overview

Form 1099-K reports payment card and third-party network transactions. If you receive payments through platforms like Stripe, Square, or PayPal, you may receive this form. For 2024, the reporting threshold is $5,000 in transactions. Lower thresholds previously proposed have been delayed.

3. Reporting Requirements

All income must be reported regardless of whether you receive a 1099 form. The IRS receives copies of 1099-NEC and 1099-K forms and matches them to your return. Discrepancies can trigger correspondence audits or inquiries.

4. Reconciling Multiple 1099s

If you receive both 1099-NEC and 1099-K for the same payments, do not double-count income. Compare Box 1 of 1099-NEC with the gross amount on 1099-K. Payments processed through payment platforms but also reported on 1099-NEC should only be reported once on Schedule C.

5. Documentation Practices

Maintain a log of all signings performed, including date, company name, signing fee, and payment method. This documentation supports your tax return if amounts reported on 1099 forms do not match your records. Discrepancies should be addressed by contacting the payer.
